A Lafayette County man has received five years probation for his role in what local law enforcement ruled an accidental shooting in early 2016.

Austin McLarty, 22, of Lafayette County was indicted in July 2016 on a charge of culpable negligence manslaughter after his cousin and roommate, Hunter Escue, 18, was fatally shot while the two were handling firearms.

No charges were filed against McLarty by the Oxford Police Department at the time of the incident; however, the case was sent to the grand jury.

McLarty pleaded guilty on Oct. 10 before Circuit Court Judge John Gregory who sentenced McLarty to five years of supervised probation.

McLarty is the son of Lafayette County Supervisor Chad McLarty.

Mother receives 3 years probation

The mother of a child who suffered a broken jaw during a fight between his parents was sentenced to three years probation.

Sabrina Holden, 20, was involved in a physical altercation with Daniel Dukes, 23, in January when their then-10-month old child was allegedly dropped to the ground and suffered a broken jaw.

Holden and Dukes were charged with child neglect.

Holden pleaded guilty on Oct. 23 and was sentenced by Circuit Court Judge Andrew Howorth to three years of unsupervised probation.

Dukes is still awaiting trial.

LEGAL LINGO DEFINED

When a case is retired to files, the charges are not prosecuted but have not been dismissed either. They are not usually brought up again unless the defendant commits another similar crime.

If a sentence is suspended, the defendant may, or may not, serve some time in prison and then is generally placed on probation. If the probation is violated, they could go back to jail to serve the remainder of the suspended sentence.

Intense supervised probation is essentially house arrest where a defendant must remain home unless at work, church or other pre-approved locations.

Misdemeanor charges can appear in the court term for two reasons. Generally, they are handled at the lower court level first but then appealed to the Circuit Court, like first-time DUI charges. Some felony charges are reduced to a misdemeanor as part of a plea agreement.
